Literary Analysis of Kate Grenvilles The Secret River Essay
Kate Grenville is one of Australiaââ¬â¢s best known authors, she was born in 1950 in Sidney, Australia. She has won many national and international awards for her writing about Australiaââ¬â¢s past and the interactions that may have been taking place between the first settlers and the aborigines. The Secret River was one of these popular novels, which is exploring the past, although it is only historical fiction. The inspiration for writing these historical fictions, came from the fact that she did not knew much about her ancestors which settled on a river named Hawkesbury River in New South Wales. The narrator significantly controls the reader; we get a sense of understanding for his situation, we share his concerns and fear because we are able to read his thoughts, and that may be the main reason for why Kate Grenville uses this narration type. William Thornhill is a convict likely from England, who has been sent to His Majestyââ¬â¢s penal colony, he is married and a father to two children as well. There is not much information regarding his physical appearance in the novel, although there are many psychological indicators. William is suffering mentally because he knows that he will never return home. ââ¬Å"This was a place, like death, from which men did not return homeâ⬠and ââ¬Å"He would die here under these alien stars, his bones rot in this cold earthâ⬠These statements or thoughts indicates clearly what he fears, but before the night is through he gets other concerns, such as his and the familyââ¬â¢s security. Brazil Essay Today over 60 million people practice Vodun worldwide. Religious similar to Vodun can be found in South America where they are called Umbanda, Quimbanda or Candomble. It is widely practiced in Benin, where it is the official religion. Vodun (a.k.a. Vodoun, Voudou, Voodoo, Sevi Lwa) is commonly called Voodoo by the public. The name is traceable to an African word for spirit. Voduns roots go back to the West African Yoruba people who lived in 18th and 19th century Dahomey. That country occupied parts of todays Togo, Benin and Nigeria. Slaves brought their religion with them when they were forcibly shipped to Haiti and other islands in the West Indies. the actual religion, Vodun practiced in Benin, Haiti, Dominican Republic and various centers in the US largely where Haitian refuges have settled. an evil, imaginary religion, which we will call Voodoo. It has been created for Hollywood movies, complete with voodoo dolls, violence, bizarre rituals, etc. It does not exist in reality, except in the minds of most non-Voduns. History of Vodun in the West Slaves were baptized into the Roman Catholic Church upon their arrival in Haiti and other West Indian islands. However, there was little Christian infrastructure present during the early 19th century to maintain the faith. The result was that the slaves largely followed original native faith. This they practiced in secret, even while attending Mass regularly. An inaccurate and sensational book (S. St. John, Haiti or the Black Republic) was written in 1884. It described Vodun as a profoundly evil religion, and included lurid descriptions of human sacrifice, cannibalism, etc. , some of which had been extracted from Vodun priests by torture. This book caught the imagination of people outside the West Indies, and was responsible for much of the misunderstanding and fear that is present today. Hollywood found this a rich source for Voodoo screen plays. Horror movies began in the 1930s and continue today to misrepresent Vodun. It is only since the late 1950s that accurate studies by anthropologists have been published. Other religions (Macumba, Candomble, Umbanda and Santeria) bear many similarities to Vodun. Vodun Beliefs Vodun, like Christianity, is a religion of many traditions. Each group follows a different spiritual path and worships a slightly different pantheon of spirits, called Loa. The word means mystery in the Yoruba language. Yoruba traditional belief included a chief God Olorun, who is remote and unknowable. He authorized a lesser God Obatala to create the earth and all life forms. A battle between the two Gods led to Obatalas temporary banishment. There are hundreds of minor spirits. Those which originated from Dahomey are called Rada; those who were added later are often deceased leaders in the new world and are called Petro. Was Machiavelli Satan? The Church accused Niccolo Machiavelli of being Satan for writing his book The Prince. Machiavelli completed The Prince in 1513. He wrote it as a gift to Lorenzo Medici, called the Magnificent, ruler of Florence. The political views Machiavelli expressed in his book went against the theology of the Church, specifically the Ten Commandments and the Beatitudes. Machiavelli wrote to gain control of a principality one must be brutal. (I)f you are a prince in possession of a newly acquired state and deem it necessary. . . to annihilate those who can or must attack you. . . . , you must do so to protect your principality. He gave the example of Duke Valentino's slaying of his nobles to maintain order, saying if Valentino had not killed his men, Valentino would have lost power. The Bible strongly forbids the killing of anyone. The Sixth Commandment states You shall not murder. In what is known as the Beatitudes, from Jesus' Sermon on the Mount, the Bible also says those who are meek shall inherit the earth. A meek person certainly does not kill others for standing in his or her way like Machiavelli is suggesting to be done. Another verse from the Beatitudes says those who are peacemakers will be called sons of God. Peacemakers do not kill either. For Machiavelli to say if killing a person is for the betterment of your principality, then to do so went against God's rule and the Church's. True followers of the Church abide by the Church beliefs, because if you are not for God, you are for Satan. As a ruler a prince must make certain pledges and steadfast promises; however, Machiavelli reasons that a prince does not have to keep his word all the time. The prince can pledge one thing under certain circumstances; but if those circumstances change, he is free to change his pledge if the change should benefit his situation. For instance, Pope Alexander VI, who reigned before Machiavelli wrote The Prince, made promises more persuasively or swore to them more solemnly and kept so few of them . . . . Pope Alexander VI also got what he wanted by deceiving others. The Beatitudes say those who desire righteousness will be filled; those who are pure of heart will see God. Righteousness and purity do not occur through deception. The ninth of the Ten Commandments says You shall not give false testimony against your neighbor, meaning do not lie. Matthew, the first book of the New Testament, says Do no break your oath . . . . The Church had good reason to disagree with Machiavelli about cra ftiness. Nobility for princes can be seen as one of two ways: generous or parsimonious. If a prince is generous, his generosity usually comes at the expense of his subjects. The prince would have to tax his people heavily in order to give. This will begin to make him odious to his subjects and . . . will lose him the respect of everyone. For a prince to give money, he need not tax his people, rather give what he pillaged and stole while on various campaigns. If a prince is stingy with the peoples money, he will not tax as much; thus, his subjects will honor him more. The teachings of the Church and the Bible promote generosity, and remark that keeping one's wealth to oneself will lead to self destruction, Hell. The teachings likewise include You shall not steal. Although his ideas were contrary to those of the Church and of the Bible, Machiavelli can not be compared with Satan. He was promoting the survival of a principality at any cost. He said a prince will find things which, though seeming good, will lead to his ruin if pursued, and others which, though seeming evil, will result in his safety and well-being. Machiavelli also said that if a ruler gains control by cruelty and wickedness the ruler is without virtue, and he cannot be compared to men of good character. Moreover, animal rights defenders now insist on the prohibition of using animal labor. For example, donkeys, camels and other animals cannot be used for hard labor, under any circumstances. As a rule, people tend to divide animal rights and human rights. However, in terms of morality, there should be no difference between adult animals and adult human beings, since animals also have rights, and humans are also mammals. Many people consider animals to be equal to people, and give a number of arguments in favor of such an assertion. Animals realize themselves, they understand that they are alive, they realize their biological structure. Animals understand what is happening to them; they like some things, and donââ¬â¢t like others. Animals are also capable of making decisions. In terms of ethics, you cannot hunt any animal. Hunting shouldnââ¬â¢t be considered acceptable under any conditions, nor on any grounds. Similarly, itââ¬â¢s immoral to use animals for entertainment, restricting their freedom in zoos, or using them to attract tourists. If we give the same attention to animal rights as human rights, it becomes obvious that any animal has the right to be treated with respect. We must realize the value of each animal as an individual. This means that we must take care of animals, but shouldnââ¬â¢t use them for our own purposes or, even more so, for simple entertainment. For many years, animals have been used for research. Due to such scientific tests, animals die, suffer from pain. Their rights are violated. Since starting Reedsy, Iââ¬â¢ve heard time and again that ââ¬Å"what authors need most help with is marketing.â⬠But thatââ¬â¢s akin to saying startups like us primarily need help with fundraising; to me, itââ¬â¢s a startup founderââ¬â¢s job to raise funds when the company needs them, just as itââ¬â¢s a writerââ¬â¢s task to sell his or her book. Sure, help would be appreciated, but going as far as outsourcing? The best startups donââ¬â¢t do that.Of course, I can see the case for bringing on a marketing specialist, particularly when an author is not technically savvy or familiar with social networks and communities. Still, this raises the question: who is best placed to promote an authorââ¬â¢s work? If promotion isnââ¬â¢t done by the creator himself, isnââ¬â¢t there a chance the message will get lost?These are several of the questions I asked author Jonathan Gould, who decided to partner with book marketer Mike Doane for the promotion of his latest book, Magnus Opum.Book marketer: it begins with strategyââ¬Å"It begins with strategy,â⬠says Gould. ââ¬Å"I have very little idea about how to strategize a book selling campaign. Thatââ¬â¢s where Mike comes in. From the very beginning, we discussed my goals as a writer, and the sorts of books I like to write. From that, Mike can not only give me advice on which readers I should be reaching out to but also suggestions on how to reach them. Together we are in the process of developing an overall strategy that should help get my name out and define me as a writer with a distinct style and voice.â⬠Iââ¬â¢ve gotten to know quite a few authors just like Jonathan: they blog on a regular basis, spend time on Twitter and Facebook, do Goodreads giveaways, and write to bloggers and reviewers. But not everyone takes time to assess their objectives with each of these marketing tasks.A good book marketer can (or should) help you identify your target audience, find ways to reach out to it, and measure the results of your efforts in each marketing ââ¬Å"channelâ⬠so you can focus on the ones that work. You end up doing the work (reaching out to reviewers, interacting with readers, etc.), so it doesnââ¬â¢t endanger your brand image or your relationship-building. And you know why youââ¬â¢re doing what youââ¬â¢re doing.Mike Doane explains: ââ¬Å"I think a lot of authors do those things theyââ¬â¢re supposed to do without knowing the reasons why. ââ¬ËI blog once a weekââ¬â¢ is not a strategy, itââ¬â¢s a tactic. Whatââ¬â¢s even worse is not being able to measure the outcomes, let alone produce outcomes to measure. This is my job. Iââ¬â¢m supposed to help Jonathan understand why heââ¬â¢s using the tactics heââ¬â¢s using, plus find new tactics and help him test them.â⬠Essentially, thatââ¬â¢s what a ââ¬Å"marketing planâ⬠is all about, and there is a certain skill to putting one together that not every author has taken the time to learn. That said, there is a vast amount of content out there around ââ¬Å"book marketingâ⬠, whether in the form of blog posts, podcasts, webinars, online courses, or even books. Our initial thought was that there is no reason why an author couldnââ¬â¢t learn this on his own (while in contrast, specialized skills like editing and design can take years to learn and perfect). So I asked several authors on forums: what does hiring a personal book marketer bring that you couldnââ¬â¢t achieve on your own with enough time and effort?Personalized advice, moral support, and an extra pair of legsAs indie author and marketing consultant Debbie Young told me: ââ¬Å"Authors often have very unrealistic expectations of how hard itââ¬â¢s going to be to market a book. Too often authors get discouraged and stop trying to market at all, but with a little direction and encouragement of the kind Iââ¬â¢m able to offer, they discover that actually there is a lot they can do after all, and they are re-enthused to do it.â⬠The degree of moral support a personalized marketing consultant can give you might actually be the most valuable part of that collaboration. The same way a good content editor can help you gain confidence in your craft, a good book marketer should be able to teach you how to promote your book in a more confident and effective way.Plus, as Jonathan puts it, ââ¬Å"Itââ¬â¢s nice to have an extra pair of legs when it comes to chasing promotional opportunities such as guest posts, interviews, or paid promotions.â⬠This touches on the subject of personal VAs (Virtual Assistants), which was brilliantly covered on Joanna Pennââ¬â¢s blog recently.Flat fee remuneration or royalty-share?Of course, this extra pair of legs doesnââ¬â¢t come for free. And how much (or even how) you should pay for marketing help is a slightly controversial question.Jonathan and Mike have contracted on a royalty-share basis. This is something that you rarely see for editing or design services, but is a much more frequent occurrence in narration (audiobook) or translation services.The logic behind it is pretty simple: a marketerââ¬â¢s only job is to generate sales for your books, so it makes sense to index the marketerââ¬â¢s remuneration on the results of their work. However, in nearly every other marketing-related profession, such as publicity, flat fees are the norm. I donââ¬â¢t know of one good book publicist who works on a royalty-share basis. Mike explains why: ââ¬Å"Any author-publicist contract thatââ¬â¢s based around sales is foolish. Itââ¬â¢s like those SEO companies that promise a #1 position on Google for a given keyword. Thatââ¬â¢s extremely hard to deliver, especially on a budget. Publicists canââ¬â¢t promise things like reviews or sales. There are just too many factors involved.â⬠As marketers develop deeper, longer-lasting relationships with the authors they partner with, royalty- share might make more sense for them than for publicists or SEO specialists. Whether it makes sense to the author is another question, and one that largely depends on sales, budget-consciousness and risk-aversion. Mike suggested to me that he would like to see a flexible model where authors and marketers can choose to work together on a mix of fee and royalty-share.This would have the advantage of keeping a bonus element (royalty) to incentivize the book marketer, while assuring that he gets paid a decent remuneration even if the book fails to sell well. There is no guarantee in book marketing and asking the marketer to assume all the risk makes little sense. Also the moon landing is believed to be a fake. There are many facts that point against it. In a video from the moon the flag that Neil Armstrong put up was waving in the wind. They cut what they dont want people to hear, which helps them things look negative and positive. This is a typical example of distortion as it twists the truth or the reality. Photography has created a new genre of art available to people. This invention allows people to see an image as it was meant to be which may have been something that could only be seen in the moment, like a fox and kits playing in the forest. Lights have affected almost every part of the average personââ¬â¢s everyday life and similarly, lighting has made artwork change and created new options of expression. In ways of architecture, lives and structure have been improved by the production and use of metals in structure and the evolution of architecture that was started in the Crystal Palace. The first true photograph was captured in 1826 with a camera and plate exposed to the sun for eight hours. The creation from this highly impractical form of photography was called a Heliograph. Joseph Nicephore Niepceââ¬â¢s correspondent was able to create a more reasonable medium for the film upon Neipceââ¬â¢s death. The silver iodine coated copper plate, named a daguerreotype after the inventor, gave hope for the creation of photography by allowing a picture to be captured in 10-20 minutes. Before this time only the rich could afford to have portraits done and could only be done by paint (Getlein 197-98). Camera and film was created in more of a form known to us in the middle 1880ââ¬â¢s. Film was an important creation, as it allowed an image to be replicated, unlike the daguerreotypes, which were positives and allowed no way of copying. Photography was able to become a hobby and to advance after the creation of the Kodak Camera in 1888 (198-99). Because of this creation the artistic world changed to be able to include photojournalism, movies and artistic photography. Film and cameras have completely changed the way images are captured and who can afford it. During modern times, we can now afford to take pictures of whatever we would like so the content for photographs is now only limited to our own morals and what is available on the physicalà plane. This invention allowed many people to share images of the world that many people would not be able to see otherwise and enabled any person who is willing to try, a chance to become an artist. The availability of electricity and the invention of the first functioning light bulb in 1820 by Warren De La Rue (The History of the Light Bulb 1) changed the way art is seen and creates. Light can be the focus of the artwork or change the way the art is seen. The best example of light in artwork is photography. The addition of a light bulb to create a flash while taking pictures has allowed different environments for photography by allowing pictures to have a good light source in the front to counteract any negative lighting, like from the back or too little lighting to allow the film to develop properly. This allowed artists more freedom to take picture wherever they are inspired and in normally inadequate lighting. This also prevented the light from behind the subject from being too strong to create the subject as a shadow, thus allowing breathtaking photographs that would have not been able to be captured otherwise. In other ways, lights have been the focal point of art in modern The first example of metal being used as a construction material for true structures was in England around 1851. Joseph Paxton used his plans for greenhouses and magnified them into a building that spanned over 13 acres, showing the world the first glimpse of modern architecture. Because of the use of pre fabrication, also a new concept, this building was able to be constructed in 16 weeks. (Getlein 295) The uses of metal in construction also lead to a new concept design for buildings: skeleton and skin. Skeleton and skin constructed involved a frame with covering over it. In the Crystal Palace, the skin was glass and in modern housing you have drywall, wood, and metal or plastic siding. The idea for modern buildings is just about the same, using metal as the sturdy skeleton with glass as the main covering but using the more modern element of concrete as a secondary structural base and covering. Through the creation of the Crystal palace, the ideas of architecture were changed forever. The metal structure allowed architects in modern times to create towering skyscrapers that would not have been possible using previous materials and allowed the shape of buildings to change as metal is more flexible has a strong tensile strength (Piggott 78). This allowed the creation of amazing bridges that are supported minimally by vertical bases and buildings that can take almost any shape. The Sydneyà Opera house is an amazing structure that is meant to resemble sails, and is constructed of metal rods, to support the specialized concrete called ferroconcrete (Getlein 300). This multipurpose building would have never been thought of as a possibility without the use of a metal skeleton and continues to allow architects more creativity to build structures with intricacy and still have the structural security needed. Influence of Cartoon on Children Essay
Cartoons are the most frequent and easily accessible source of entertainment which we provide to children. With the vastness of media and extension of channels, it has become easier for children to watch their favourite cartoons on a single click and at the same time it has become more convenient for parents to provide children with this all-time favourite activity of theirs. Time which was previously spent by children in outdoor activities is now replaced, as now they can be found glued to the TV sets for long hours, peering at all sorts of cartoons, mostly without the supervision of elders who are completely unaware that this might have certain effects on their psychological development later on displayed in their behaviour patterns. There is a wide range of cartoons from fairy tales like ââ¬ËBeauty and the Beastââ¬â¢ to action-based cartoons like ââ¬ËBen Tenââ¬â¢ and ââ¬ËPokemonââ¬â¢. Children between the ages of 6-8 have different preferences; girls are usually into fairy tales and animated ââ¬ËBarbieââ¬â¢ series whereas boys and some girls even usually have their favourite super hero cartoons like ââ¬ËSpidermanââ¬â¢ or ââ¬ËBatmanââ¬â¢ or action flicks like ââ¬ËBay Bladeââ¬â¢ or ââ¬ËDragon Ball-zââ¬â¢. Children are at a stage when their minds are developing and forms impressions easily so parents need to be careful what they expose them with. Children have become much more interested in cartoons over many years and it has become a primary action to some lives. Typically, children begin watching cartoons on television at an early age of six months, and by the age two or three children become enthusiastic viewers. This has become a problem because too many children are watching too much television and the shows that they are watching (even if they are cartoons) have become violent and addictive. The marketing of cartoons has become overpowering in the United States and so has the subliminal messaging. The marketing is targeted toward the children to cause them to want to view the cartoons on a regular basis, but the subliminal messaging is for the adultsââ¬â¢ to target them into enjoying the ââ¬Å"cartoonsâ⬠. This is unfortunate because children watch the cartoons on the television and they see material that is not appropriate for their age group. The Children who watch too much cartoons on television are more likely to have mental and emotional problems, along with brain and eye injuries and unexpectedly the risk of a physical problem increases. Televisionââ¬â¢s Effect on the Brain and Eyes In December 1997, an episode of the Japanese cartoon ââ¬Å"Pocket Monsterâ⬠(later renamed ââ¬Å"Pokemonâ⬠for international distribution) drew worldwide attention after multiple cases of children suffering seizures after watching the episode were reported (Warner, 2004). Parents began to wonder how the cartoons their children watched affected their mental development. While no former study specifically relating to cartoons has taken place, multiple studies over the years have charted the impact of television on the minds and eyes of developing children. Most eye specialists agree that watching television is not a danger to the eyes, as long as children watch in the right conditions. The room should not be pitch black, and children should not sit closer than five feet away from the screen. Sitting in a dark room or closer than five feet will not damage the eyes, but will result in eye fatigue. (Adams, 1992). As for the brain, there is scientific evidence that too much television can be detrimental to children. The April 2004 issue of the medical journal Pediatrics published a study done by Childrenââ¬â¢s Hospital and Regional Medical Center of Seattle, Washington. The study revealed that children who watched three to four hours of television daily had a 30 to 40 percent greater risk of developing attention deficit disorder than children who did not watch television. While no specific program is directly responsible, Dr. Dimitri Christakis, leader of the study, speculates that the speed of the images displayed could affect childrenââ¬â¢s brains (Todayââ¬â¢s Chiropractic, 2004). But does watching television give young children seizures? Yes, and no. A study released by The New England Journal of Medicine in July 2004 found that most children who suffered seizures from that December 1997 episode of ââ¬Å"Pocket Monstersâ⬠had epilepsy, or some other underlying condition that would have caused development of seizures, regardless of whether or not they saw that program (Warner, 2004). TVââ¬â¢s Effect on Childrenââ¬â¢s Behavior Television has long been criticized for influencing our children. People complain that certain TV shows are having negative effects on their children. The American Academy of Pediatrics (AAP) and the American Academy of Child and Adolescent Psychiatry (AACAP) both feel that TV does influence the behavior of children as young as one year old. From their studies, the AACAP states, ââ¬Å"Children who view shows in which violence is very realistic, frequently repeated or unpunished, are more likely to imitate what they see. This speaks to the impressionable mindsets of young children, who are still learning control of their minds and bodies, and are likely to mimic what they see, as it seems quite normal to them. The AACAP also stresses the need for parents to keep a close eye on what their children watch. They must be there, the AACAP says, to explain that the cartoon character or actor that was shot has not been harmed, but would actually be seriously injured, or die in real life. They should also work to tell their children that violent behavior is not the best course of action to resolve a conflict. The AAP states ââ¬Å"Neuroscientists have shown that environmental experiences significantly shape the developing brain. â⬠This again adds to the idea that young children are very impressionable. They paid more attention to the effect of TV on children in their daily lives. ââ¬Å"Higher levelsâ⬠the AAP states, ââ¬Å"of television viewing correlate with lowered academic performance, especially reading scores. This may be because television substitutes for reading practice, partially because the compellingly visual nature of the stimulus blocks development of left-hemisphere language circuitry. A young brain manipulated by jazzy visual effects cannot divide attention to listen carefully to language. â⬠TV is a very quick medium. Messages are shot at the viewer as if by an automatic rifle. Their minds must be equally as quick to interpret the messages, and with such a ââ¬Å"two-minute mindâ⬠, many messages are misinterpreted, or confused. When the child becomes used to receiving information at so fast a rate, they lose interest in information that is more detailed and methodical, such as the information received in day-to-day schooling. Television certainly does affect the children, who find themselves mesmerized by the bright flashing objects, and rapid assault of messages. It is good to know that the leaders of our medical professions feel that parents and supervisors of children are able to help slow the information down, and explain what the messages really mean, so as to have a more positive effect on our children. Auditory Subliminal Messaging in Childrenââ¬â¢s Cartoons The lessons that the media conveys to those parts of the mind without conscious perception through the cartoons that people watch, are referred to as subliminal messages. When children watch cartoons, they always pay attention to what is being said. In a childââ¬â¢s subconscious mind, he or she is exposed to auditory subliminal messages that they may never discover, but they will eventually become a part of their lives. Not all auditory subliminal messaging is negative. However, most of these messages have a negative effect on children. The interesting thing about the situation is that these messages are most common in popular cartoons. SpongeBob Squarepants has been on the air since 1999 on Nickelodeon. Today, it still remains popular and new episodes are still being created. It is now 2004 and people are speaking out against the messages that they found hidden in a number of episodes. The main allegation against SpongeBob Squarepants is its use of metaphors in place of profanity. When he is disappointed, SpongeBob will often yell out ââ¬Å"Tartar Sauceâ⬠. To an adult ear, that phrase may sound like it is intended to represent a curse word. Also belonging to the Nickelodeon station is ââ¬Å"Rugratsâ⬠. It has been on the air since 1991. The show is often seen as prurient or ââ¬Å"sex drivenâ⬠. The last name of the main characters is ââ¬Å"Picklesâ⬠which is a euphemism for the male genitalia. Lou Pickles usually calls his grandson, Tommy Pickles by the name ââ¬Å"sproutâ⬠. It has been argued that this nickname is also a euphemism for the male genitalia as well. Angelica Pickles represents the S&M of ââ¬Å"Rugratsâ⬠because constantly physically and verbally abuses the babies. Lesbianism is also portrayed in this cartoon. Phil and Lilââ¬â¢s mom, Betty Deville is what we would call a ââ¬Å"Bull Dykeâ⬠because she wears a bandana, hangs out with feminine women, yells a lot, and loves sports. When parents choose what cartoons to let their children watch, they want to make sure that these cartoons are appropriate for general audiences. If a parent was to find profane or sexual language in the content of a cartoon, they wouldnââ¬â¢t allow their children to watch that cartoon anymore. People who create popular cartoons are careful to not allow any vulgar content to be incorporated into their cartoons. However, every cartoon canââ¬â¢t be made perfectly safe for viewing by children and some of the verbal content may be mistaken for auditory subliminal messages.

This was a great honor for Linda, since very few people were considered worthy or fortunate to visit the reservation. While Linda and Tomakin were on their trip they became separated. Tomakin and others searched in vain for Linda. They abandoned the search assuming Linda had met her demise and returned to the Brave New World. In reality, Linda was very much alive, well, and pregnant. Linda gave birth to Tomakin's love child , whom she named John. Linda was overwhelmed and devastated by this blessed event. She could not imagine something so horrible and at the same time so wonderful happening to her. It is true that Linda was not a good mother. This is understandable, given her "conditioning". Breach of Contract and Negligence 1)à Mega will be looking to bring an action in breach of contract and negligence against Super for both their failure to install the cash machines until December 2006 and the negligent installation my Tom and Manoj which caused the registers to be out of action over the Christmas period. The problem they will have with this is that Super trade under a standard contract which contains clauses which apparently exclude liability for both delay to installation and consequential loss arising in either contract or tort. This includes the loss of profit which Mega wish to claim form them. However, it may well be that Super are not able to rely on those clauses. For an exclusion clause to be effective it must first be validly incorporated into the contract. Then the construction must be such that on a proper interpretation it covers the type of liability which has arisen. Each of these issues will be discussed in turn to establish whether or not Super will be able to fend off an action by Mega by relying on the exclusion clauses. To be effective as an exclusion clause the term must be incorporated into the contract at the time when the contract was made. It will not be effective if it is added at a later stage[1]. The terms must be contained or referred to in a document which is intended to have contractual effect. In the case of Superââ¬â¢s standard terms they are referred to in brochures, order forms, price lists and quotations and reprinted in invoices and receipts. It is likely that order forms would be considered to be a document with contractual effect. In the present case, however, Super took the order from Mega over the telephone. The contract would have been concluded at that time. It is therefore necessary that the exclusion clauses be incorporated at that time. For a clause to be validly incorporated the other party must be given notice of its existence. At this stage there is no details of the discussion between Mega and Super when hew order was taken. What is clear is that if the exclusion clauses were not mentioned in the telephone conversation and Mega did not know about them then they will not be validly incorporated by their inclusion in the invoice or receipt[2]. What amounts to reasonable notice will depend on the facts of the case. If it can be shown that Mega had actual knowledge of the terms they will be reasonably incorporated. It might well be for example that they had read the brochure and were therefore alerted to the existence of standard terms and should reasonably have enquired as to what they were. The fact that a party has to take further steps to find out what the terms of which he has been given notice are does not necessarily mean that reasonable notice has not been given.[3] However, it seems more likely on balance that the courts would hold that a mere reference to the standard terms in these pre contractual documents is insufficient notice of an exclusion clause. The present clauses are particularly onerous as they attempt to exclude a substantial amount of liability on the part of Super. In the case of Spurling Ltd v Bradshaw [1956] 1 WLR 461 Lord Denning held that the more onerous the clause the more that would have to be done to bring it to the attention of the other party. He stated that in some cases the clause would have to be printed in bright red ink with a big red hand pointing to it. This has become known as the red hand test. In the present case it would seem that some form of red hand would be required for there to be sufficient notice of the exclusion clauses. Therefore if Super did not specifically draw them to the attention of Mega then they will not be validly incorporated. I will proceed on the basis that the terms were validly incorpo rated for the purposes of analysing the terms themselves, but if they were not then Super will not be able to rely on them at all. The next issue to deal with is the construction of the clauses themselves. The courts have traditionally construed exclusion clauses very restrictively. It must be show that the clause, properly interpreted does actually cover the damage caused. The ââ¬Ëcontra proferentemââ¬â¢ rule means that any ambiguity will be resolved against the party seeking to rely on the clause. There does not seem to be any ambiguity in Clause 10.2. It clearly states that they will not be liable for delay howsoever caused. At this stage it seems unlikely that Mega will be able to claim for any losses caused by the delay to the installation. It might be however that Mega can rely on the Unfair Contract Terms Act 1977 section 3 which protects parties who are either dealing as consumers or dealing on the otherââ¬â¢s standard terms of business as Mega are in this instance. Section 3(2) (b) (i) of the Act states that a party is not by reference to any term of the contract entitled to: ââ¬Å"â⬠¦render a contractual performance substantially different from that which was reasonably expected of him.â⬠It is certainly arguable that a delay of two to three months would be outside the sort of delay that would be reasonably expected of a company. On balance I would be of the opinion that the delay will not be sufficient to allow Mega to avail them self of this protection. With regards to the loss of profits over the Christmas period, Mega will have to make a claim in negligence against Super. The first point to note is that just as Tom and Manoj will be protected by the clause, Super will be vicariously liable for their actions if the clause is not held to cover negligence. Super will be relying on clause 10.3 to suggest that they have excluded liability for consequential loss, including loss of profit for the negligence of their employees. The question is whether 10.3 actually has that effect. The general rule is that if a party wishes to exclude liability for negligence they must do so explicitly[4]. In the present case though Super have not referred specifically to negligence stating: ââ¬Å"â⬠¦neither the seller nor any of its employees shall be liable for any consequential or indirect loss suffered by the Buyer whether such loss arises in contract or tort.â⬠The next step the courts will take is to establish whether the words used are wide enough to cover negligence on the part of the employees of the proferens[5]. It seems likely that Super will be able to show this as they have referred to ââ¬Ëtortââ¬â¢ However the final and rather contradictory stage is that the court must consider: â⬠¦whether the head of damage may be based on some ground other than negligenceââ¬â¢[6] There cannot be any doubt that clause 10.3 could cover something other than negligence. Even leaving out the contract section it covers every type of tort. It is clear that where this is the case the proferens (Super) will not be able to rely on the clause to exclude liability for negligence. If the clause is held to cover exclusion of liability for negligence Mega may be able to rely on the Unfair Contract Terms Act 1977. Section 2(2) of that Act states: ââ¬Å"2 Negligence liability: In the case of other (other than death or personal injury) loss or damage, a person cannot so exclude or restrict his liability for negligence except in so far as the term or notice satisfies the requirement of reasonableness.â⬠On the present facts it does not seem to be an unreasonable clause. The bargaining power of the two parties seems relatively even on the face of it and there do not appear to have been any particular inducements to enter the contract with that term included. However there may be circumstances which are not included in the instructions which would render the term unreasonable. In conclusion I would be of the opinion that subject to the clauses being found to have been validly incorporated, Super will be able to relay on clause 10.2 to avoid liability of the delay in installation. On balance I would not expect them to be able to rely on clause 10.3 to save them from liability for the negligence of Tom and Manoj as the terms is not specific enough to negligence. It seems likely that loss of profit is a reasonably foreseeable consequence of negligent installation of cash registers and therefore Super will be liable for any loss of profit suffered by Mega over the Christmas period which is attributable to the lack of functioning cash registers. Joe Pain, suffering and loss of amenity On the assumption that Katy was negligent Joe will be entitled to recover damages from her under two general heads, general damages and special damages. General damages cover the compensation which will be received by Joe for his injuries. This is commonly referred to as damages for pain suffering and loss of amenity. Pain and suffering is viewed separately to loss of amenity and I will discuss them in that order. Damages are awarded to the claimant for pain and suffering caused by the injury and any treatment relating to the injury both in the run up to trial and in the future if appropriate. It is important to bear in mind that awards for pain and suffering are subjective in that they relate to the actual pain suffered by the Claimant. In relation to Joe he is therefore unlikely to be able to claim for pain and suffering for the 2 weeks which he was unconscious.[7] This does not apply to loss of amenity which can be claimed whether the claimant was aware that they had lost amenity or not. Loss of amenity is an objective measure of the claimantââ¬â¢s losses. For example because of the loss of a limb as in Joes case. The fact that Joe can no longer row will be taken into consideration under this section of the head of damage and this is likely to result in an increased award. Overall damages are awarded for pain suffering and loss of amenity on the basis of what is fair just and reasonable.[8] The Judicial Studies Board issues guidelines as to the level of award based on recent judgments. In relation to amputations below the elbow the award is between à £56,000 and à £63,625. Which end of the scale it will be is determined by factors such as whether it was the claimantââ¬â¢s dominant arm. Loss of Earnings The claimant is entitled to be put in the position he would have been in had the injury not occurred.[9] In relation to his pre trial loss of earnings this will be the net figure which he would have earned during that period after national insurance tax and any other deductions which would have been made. We are not told at this stage whether Joe earned à £45,000 per annum before or after tax, but assuming it is after tax this would amount to à £22,500. He will also be entitled to claim the bonuses which he would have received during that period. At the most this will amount to à £6000, but Joe will have to prove that he would have earned his maximum of à £1000 per month. Whilst the à £650 does not represent wages from the employer, but a collection on the part of the other employees, I would expect it to be deducted from the loss of earnings because otherwise it would represent double recovery as Joe would not have received it without the injury. Assuming Joe returns to work before the trial there will be a further deduction from his loss of earnings award to take account of the fact that he is receiving wages at a reduced rate. For the period of time between his return to work and the trial he will receive a sum representing the net total amount he would have received as calculated above minus the net total amount he did receive as a result of his new position. Future Loss of Earnings Joeââ¬â¢s future earnings have been substantially reduced by the accident. When calculating the future loss of earnings the courts start with the net annual loos of earnings suffered by the Claimant. This sum is adjusted by taking into account other factors such as the loss of a chance to get promoted and increase earnings etc and the fact that the claimant is receiving a capital lump sum now rather than earning it over the years. The final figure is called the ââ¬Ëmultiplicandââ¬â¢. This is multiplied by the ââ¬Ëmultiplierââ¬â¢ which is the number of years for which the loss is likely to continue, usually the number of years between trial and the likely date of retirement. Other losses Joe will also be able to claim the money spent on repairing his bike in the sum of à £1500. He will have to prove the loss in the form of a repair receipt/invoice. Any savings made as a result of the NHS care will be set off against the income claim. Joe will not be able to claim for Darinderââ¬â¢s loss of earnings as they are not a loss suffered by him. However, the fact that Darinder has had to take time off work to help Joe adjust to the disability suggests that he is no longer able to perform household tasks which he would have been able to perform before the accident. Where a member of the claimantââ¬â¢s family voluntarily undertakes to perform those tasks the Claimant is entitled to an award in damages representing the value of those services.[10] The damages will be assessed on the basis of what it would have cost to employ someone else to do the tasks.[11] Other claims against Katy All of the potential claims against Katy will be for psychiatric harm. There are principles to be applied when determining who will be able to claim for psychiatric harm which will be discussed throughout this section. The basic premise is that a duty of care in relation to shock in the sense of psychiatric damage is owed to those foreseeably and directly involved in the horrific event caused by the defendants negligence.[12] Charles à Charles was clearly directly involved in the accident as he was in the car at the time. It is not necessary for him to have suffered physical injury to recover damages, the fact that he feared for his own safety and was in fact endangered by the event is sufficient.[13] He was a primary victim of the accident and therefore it is not necessary that Katy foresaw psychiatric injury specifically. The fact that injury was foreseeable is sufficient.[14] Lord Lloyd of Berwick in Page v Smith[15] reasoned that if the psychiatric injury had been as a consequence of a physical injury it would clearly be recoverable. The fortuitous absence of physical injury did not make a difference. Stella Stella witnessed the accident. Psychiatric damage caused by witnessing an event first hand may be recoverable in certain circumstances. Stella clearly perceived the accident through her own senses and was physically and temporally proximate to it as required by Alcock[16] However the third criterion in Alcock is that the witness must have a close relationship to the victim of the accident. Stella was a passer by and therefore would not satisfy this criterion. The only other way Stella could recover damages from Katy is if she could prove that she was a primary victim. The fact that she suffers from post traumatic stress disorder suggests that the accident put her in fear for her own safety and the bike did cross her path. She may therefore be in the same position as Charles. However to recover under this head the claimant must actually have been in danger.[17] Stella might have difficulty proving that she was ever in actual danger as the bike mounted the pavement in front of her not towards her. Darinder Darinder did not witness the accident first hand. The fact that she was told about it by the police officer will not be sufficient to give her the proximity required[18]. It is possible to recover damages if you witnessed the immediate aftermath of the event and that includes the hospital scenes[19]. However it is still necessary that the psychiatric injury be brought about by shock so she will have to show that seeing Joe coming out of an operating theatre caused her shock. Incidentally the close relationship tie is assumed in spousal relationships. With regard to the nervous break down brought about by the continued care of Joe, Darinder is unlikely to be able to recover. The injury must be brought about by a sudden assault to the senses rather than an accumulation of feelings and distress.[20] Overall it is unlikely that Darinder will be able to recover damages unless she can prove she was shocked by seeing Joe coming out of the operating theatre and then she will only be able to recover for psychiatric harm caused directly by that shock.
